Psynaptic Media Streaming Services

This page explains the terms by which you may use Psynaptic Media LLC online services, website, cloud streaming platform, API and any other software or services provided on or in connection with the services. By accessing or using the Psynaptic Media LLC Services, you signify that you have read, understood, and agree to be bound by these Terms of Service (the “Terms”), whether or not you are a registered user of the Psynaptic Media LLC services. This Agreement applies to all visitors, users, and others who access the Psynaptic Media LLC Services.

Psynaptic Media LLC provides the servers necessary to provide the servers. Psynaptic Media LLC will provide maintenance to the servers and services to keep them operational. The services include data storage space, unique public IPs.

• Includes a powerful Streaming Cloud Server that is dedicated to your IRL stream.
• Includes pre-configured stream system, ready for your backpack RTMP feed.
• Login to your Stream Server with full remote control of the streaming software.
• Bring your own custom videos/overlays for BRB screen. Setup Server initially, and fully controlled via web thereafter.
• Includes a pre-configured RTMP ingest server with customized stream URLs for your stream.
• Includes Web Control Dashboard for remote controlling scenes, and starting/stopping stream.
• Change your stream key and browser overlay from the Web Control Panel (great for multiple users).
• “Bitrate Detection” system to detect low-bitrates and data drops.
• “Auto-Scene Switch” when low bitrates are detected. When bitrate returns, scene switches back to IRL video source.
• Your stream URLs and all info will be sent to you upon server setup.
• Will work with any RTMP based platform (including Twitch).
• Will work with any RTMP capable mobile device (including IRL Backpack or mobile phone)

This is the “Super Stream System” currently used with the Gunrun IRL Backpack systems, which use the LiveU bonded modem technology to provide the highest quality IRL streams in Twitch history. Although the backpack provides the highest quality and most reliable IRL stream, any RTMP capable mobile device can be used (such as your phone).
Current and past Twitch IRL Backpack and Super Stream System users are JakenbakeLIVE, Rekful, Andy Milonakis, OfflineTV (Pokimane, Fedmyster, Sleightlymusical), and so many more!

This is the 720p60 setup used by the top IRL streamers (such as Jake, Andy, Rekful, and so many more).
It features an 8-core server for that 720p60 IRL footage smoothness.
185$/month + 50$ One-time Setup Fee per server. Prices may change based on market server provider costs (eg. bandwidth, server costs, etc).

Additional services, service add-ons, and custom development that are beyond the included features of the Streaming Cloud Server may be available for an additional fee. Costs will be agreed upon and customer agrees to pay the amount.

Extended support for services is available, and may include priority support, stream planning and design, and on-call availability, on-site support, and consulting for an additional fee. Costs will be agreed upon and customer agrees to pay the amount.

Customer will pay Psynaptic Media LLC per project or monthly services agreed. Each project has its own costs and Psynaptic Media LLC agrees to inform the Customer what are the costs involved when setting the quotation and the Customer agrees to pay the total amount when the project is delivered.

Monthly service charges are invoiced at the first of the month, for that month of service. All server services are paid for at the start of the month, for that month. Payment due no later than ten (10) days past the invoice date. If a payment for the server services have not been paid by the end of the month. The servers will be cancelled before the start of the next month and any outstanding balance must be settled. For cancellation of any monthly services (including invoices or subscriptions), monthly services must be canceled before the 1st of the month to avoid being charged for the next month.

For all purchased resources and services, we will send a monthly invoice or collect payment via other methods as agreed to in writing and described in a Psynaptic Media LLC invoice provided to you. Late payments may bear interest at the rate of 1.5% per month (or the highest rate permitted by law, if less). Charges are exclusive of taxes. You are responsible for paying all taxes and government charges, and all reasonable expenses and attorneys’ fees that Psynaptic Media LLC incurs in collecting late amounts. To the fullest extent permitted by law, refunds (if any) are at the discretion of Psynaptic Media LLC and only in the form of credit for the Psynaptic Media LLC Services. Nothing in these Terms obligates Psynaptic Media LLC to extend credit to any party. Psynaptic Media LLC reserves the right to discontinue the provision of the Psynaptic Media LLC Services to you for any late payments.

For all recurring purchases, Psynaptic Media LLC may change its fees and payment policies for the Psynaptic Media LLC Services by notifying you at least fifteen (15) days before the beginning of the billing cycle in which such change will take effect. Any outstanding balance becomes immediately due

YOU EXPRESSLY UNDERSTAND AND AGREE THAT PSYNAPTIC MEDIA LLC, ITS SUBSIDIARIES AND AFFILIATES, AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL CONSEQUENTIAL OR EXEMPLARY DAMAGES WHICH MAY BE INCURRED BY YOU, HOWEVER CAUSED AND UNDER ANY THEORY OF LIABILITY. THIS SHALL INCLUDE, BUT NOT BE LIMITED TO, ANY LOSS OF PROFIT (WHETHER INCURRED DIRECTLY OR INDIRECTLY), ANY LOSS OF GOODWILL OR BUSINESS REPUTATION, ANY LOSS OF DATA SUFFERED, COST OF PROCUREMENT OF SUBSTITUTE GOODS OR SERVICES, OR OTHER INTANGIBLE LOSS.

THE LIMITATIONS ON PSYNAPTIC MEDIA LLC’S LIABILITY TO YOU SHALL APPLY WHETHER OR NOT PSYNAPTIC MEDIA LLC HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES ARISING.

You agree to hold harmless and indemnify Psynaptic Media LLC, and its subsidiaries, affiliates, officers, agents, employees, advertisers, licensors, suppliers or partners from and against any third party claim arising from or in any way related to (a) your breach of the Terms, (b) your use of the Psynaptic Media LLC Services, (c) your violation of applicable laws, rules or regulations in connection with the Psynaptic Media LLC Services, or (d) your Content or your Application, including any liability or expense arising from all claims, losses, damages (actual and consequential), suits, judgments, litigation costs and attorneys’ fees, of every kind and nature. This indemnification will survive the termination of this Agreement.

Psynaptic Media LLC does not share personal information with third parties. Psynaptic Media LLC does not share any client information or data (such as stream keys or any other data stored on client machines) with third parties. Client confidentiality and privacy is a priority, and Psynaptic Media LLC makes a strong effort to protect data privacy.

All intellectual property and related material, including any trade secrets, moral rights, goodwill, relevant registrations or applications for registration, and rights in any patent, copyright, trademark, trade dress, industrial design and trade name (the “Intellectual Property”) that is developed or produced under this Agreement, will be the sole property of the Psynaptic Media LLC. The use of the Intellectual Property by Psynaptic Media LLC will not be restricted in any manner.

Psynaptic Media LLC may use the IP for any purpose without the written consent of the Client. The Client will be responsible for any and all damages resulting for the unauthorized use of the IP.
You acknowledge and agree that Psynaptic Media LLC (or Psynaptic Media LLC’s licensors) own all legal right, title and interest in and to the Psynaptic Media LLC Services, including any intellectual property rights which subsist in the Psynaptic Media LLC Services (whether those rights happen to be registered or not, and wherever in the world those rights may exist).

Psynaptic Media LLC acknowledges and agrees that it obtains no right, title or interest from you (or your licensors) under these Terms in or to any Content or Applications that you create, submit, post, transmit or display on, or through, the Psynaptic Media LLC Services, including any intellectual property rights which subsist in that Content and the Application (whether those rights happen to be registered or not, and wherever in the world those rights may exist). Unless you have agreed otherwise in writing with Psynaptic Media LLC, you agree that you are responsible for protecting and enforcing those rights and that Psynaptic Media LLC has no obligation to do so on your behalf.

Psynaptic Media LLC gives you a personal, worldwide, royalty-free, non-assignable and non-exclusive license to use the software provided to you by Psynaptic Media LLC as part of the Psynaptic Media LLC Services as provided to you by Psynaptic Media LLC. This license is for the sole purpose of enabling you to use and enjoy the benefit of the Psynaptic Media LLC Services as provided by Psynaptic Media LLC, in the manner permitted by the Terms.

You may not (and you may not permit anyone else to): (a) copy, modify, create a derivative work of, reverse engineer, decompile or otherwise attempt to extract the source code of the Psynaptic Media LLC Services or any part thereof, unless this is expressly permitted or required by law, or unless you have been specifically told that you may do so by Psynaptic Media LLC, in writing (e.g., through an open source software license); or (b) attempt to disable or circumvent any security mechanisms used by the Psynaptic Media LLC Services or any applications running on the Psynaptic Media LLC Services.

Psynaptic Media LLC hereby grants you a limited, non-exclusive, royalty-free, non-transferable license, with no right to sub-license services unless agreed by both parties.

Psynaptic Media LLC claims no ownership or control over any Content or Application. You retain copyright and any other rights you already hold in the Content and/or Application, and you are responsible for protecting those rights, as appropriate. By submitting, posting or displaying the Content and/or Application on or through the Psynaptic Media LLC Services you give Psynaptic Media LLC a worldwide, royalty-free, and non-exclusive license to reproduce, adapt, modify, translate, publish, publicly perform, publicly display and distribute such Content for the sole purpose of enabling Psynaptic Media LLC to provide you with the Psynaptic Media LLC Services.

You agree not to (a) access (or attempt to access) the administrative interface of the Psynaptic Media LLC Services by any means other than through the interfaces that are provided by Psynaptic Media LLC in connection with the Psynaptic Media LLC Services, unless you have been specifically allowed to do so in a separate agreement with Psynaptic Media LLC, or (b) engage in any activity that interferes with or disrupts the Psynaptic Media LLC Services (or the servers and networks which are connected to the Service). You may not access the Psynaptic Media LLC Services for the purpose of bringing an intellectual property infringement claim against Psynaptic Media LLC or for the purpose of creating a product or service competitive with the Psynaptic Media LLC Services.

Psynaptic Media LLC is constantly innovating in order to provide the best possible experience for its users. You acknowledge and agree that the form and nature of the Psynaptic Media LLC Services which Psynaptic Media LLC provides may change from time to time without prior notice to you. Changes to the form and nature of the Psynaptic Media LLC Services will be effective with respect to all versions of the Psynaptic Media LLC Services; examples of changes to the form and nature of the Psynaptic Media LLC Services include without limitation changes to fee and payment policies, security patches, added functionality, and other enhancements.

You may terminate these Terms at any time by canceling your account on the Psynaptic Media LLC Services.

You agree that Psynaptic Media LLC, in its sole discretion and for any or no reason, may terminate your account or any part thereof. You agree that any termination of your access to the Psynaptic Media LLC Services may be without prior notice, and you agree that Psynaptic Media LLC will not be liable to you or any third party for such termination.
